Daytona Beach, FL – A Seville man with a long rap sheet is back in jail, this time for shooting another man near the Bethune-Cookman University campus and pointing his gun at construction workers while he fled the scene.

31-year-old Herbert A. Jenkins Jr. was arrested at an apartment on Weaver Street soon after the shooting around 9:30am Monday at Joe Harris Park.

The Daytona Beach Police Department says the victim – also a 31-year-old man – was shot in the lower left leg in front of a group of workers building a new BCU residence hall off of Dr. Mary McLeod Bethune Boulevard.

The victim was taken by paramedics to Halifax Health Medical Center in Daytona Beach and is expected to recover.

Investigators believe Jenkins shot the man in a dispute over a girl and then ran from the park with a gun in his hand towards the intersection of MMB and Dr. Martin Luther King Boulevard.

DBPD says some of the construction workers chased Jenkins on foot soon after the shots were fired and that those workers helped officers identify Jenkins as the shooter soon after he broke into the apartment and hid in a closet.

Jenkins is facing 4 counts of aggravated assault with a firearm, possession of a firearm and ammunition by a convicted felon and aggravated battery causing bodily harm. All of those are felonies.

As of 2pm Monday, Jenkins has yet to be booked at Volusia County Jail, but VCJ records do show he’s been booked there 19 other times since November 2001, including this past June 16th for aggravated assault with a deadly weapon.

Jenkins will be held on $23,000 bond at VCJ once he’s processed, according to his DBPD charging affidavit.

The affidavit also noted that police found a baseball bat, a knife, 7 .32 caliber rounds and clothes under a bench at the park pavilion while processing the crime scene.

Florida Department of Corrections records shows Jenkins served just over a year in jail after he was sentenced to 30 months in jail for selling and possessing cocaine as well as resisting an officer in Volusia County. He was released in April 2007.
