Daytona Beach, FL – The pregnant Virginia woman shot during a fatal traffic stop in Barberville last month is heading back to Volusia County Jail.
19-year-old Shannon Murphy has now been charged with felony grand theft auto and carrying a concealed weapon in the September 21st incident that saw 26-year-old Timothy Wagner shot and killed around 11:30pm that night on State Road 40 just west of County Road 3.
Volusia County Sheriff’s Office spokesman Andrew Gant says the arrest warrant came in on Wednesday and that Murphy is currently at the Jackson County Correctional Facility in Marianna. It’s unclear at this time when she’ll be coming back to VCJ.
Murphy was initially booked at VCJ 4 days after the shooting on a charge of grand theft of a motor vehicle, hours after she was discharged from Halifax Health Medical Center in Daytona Beach.
She was then sent to JCCF because the 2006 GMC truck she was allegedly driving that night was reported stolen in that Panhandle county, per Gant.
Murphy – who was 6 months pregnant at the time, according to Volusia County Sheriff Ben Johnson – was airlifted to HHMC soon after a bullet went through her shoulder.
According to VCSO, Murphy was behind the wheel of that stolen truck going westbound on SR 40 when she was pulled over by a deputy for a burned out tail light.
That deputy – William Kretzer – waited for fellow VCSO Deputy Daniel Sweeley to arrive before both of them approached the truck and spoke to Murphy and Wagner, who was sitting in a passenger seat, per the incident report.
That’s when VCSO says Wagner pulled out a gun and fired shots at both deputies, with both deputies returning fire.
Wagner died in the truck, where deputies also found 2 guns, including the one Wagner allegedly used to shoot at Kretzer and Sweeley, per VCSO.
It isn’t clear at this point who shot Murphy, but VCSO did note that she’s been cooperative in the investigation.
Neither deputy was injured in the shooting, but both have been placed on paid leave while the Florida Department of Law Enforcement investigates.
Johnson noted during a press conference the following morning that it was “pure luck” neither deputy was shot and that Wagner “got what he deserved” for trying to “kill my officers”.
Kretzer is 51 years old and has been with VCSO since October 2002. Sweeley is 35 years old and was hired by VCSO in November 2011.
Wagner and Murphy are both from the Virginia city of Marion, according to VCSO.
