Ormond Beach, FL – A 58-year-old Ormond Beach man is behind bars for threatening to shoot a neighbor and his dogs with a BB gun.

Patrick L. Ryan was “highly intoxicated” and also called 911 to complain about the deputy who showed up to his Linda Lane home on Saturday night to investigate, according to the Volusia County Sheriff’s Office arrest report.

A VCSO deputy arrived at Ryan’s home around 7pm Saturday after one of Ryan’s neighbors claimed he pointed a black rifle with a scope mounted on top at him and his dogs and threatened to shoot.

According to the report, the 61-year-old neighbor told VCSO he went to the backyard to see why his dogs were barking and that’s when he saw Ryan leaning over a wooden fence with a rifle in his hands.

Investigators think Ryan was able to lean over the fence by climbing onto a boat parked near the fence that separates his backyard from his neighbor’s backyard.

Ryan’s neighbor claims Ryan pointed the rifle at the dogs and threatened to shoot them, then did the same to him when he told Ryan he was calling law enforcement.

The neighbor managed to get the dogs inside the home before any shots were fired, per VCSO.

The deputy noted in the arrest report that Ryan refused to leave his backyard at first to speak to the deputies, but that Ryan did get close enough for the deputy to smell a “strong” odor of alcohol and see that he had blood-shot watery eyes and trouble keeping his balance when walking or standing.

When questioned, Ryan called the deputy an expletive and told him to get off of his property or that he was going to call 911 to have him removed, per the report.

Ryan actually did call 911 a few minutes later after the deputy refused to leave, demanding to speak to a supervisor, according to dispatchers.

A VCSO sergeant responded to the scene and managed to take Ryan into custody after Ryan agreed to leave his home and talk to them, per the report.

A deputy discovered the rifle leaning next to a door frame and found that it was really a Gamo pellet gun.

Ryan “did nothing but scream and yell” at deputies who tried to question him and advise him of his legal rights after he was taken into custody, according to the report.

As of 2pm Monday, Ryan is held on $26,000 bond at Volusia County Jail on charges of armed burglary, aggravated assault, making a false 911 call and criminal mischief.
